https://www.lexorbis.com/Several developments shaped India’s intellectual property scene in 2023. 

Hermes’s “H” logo joined the growing list of marks that have been declared as well-known trademarks in India when it was declared as such by the Delhi High Court in February. 

On April 12, the Madras High Court became the second court in India to have an Intellectual Property Division when the unit was inaugurated. Madras HC followed in the footsteps of the Delhi High Court whose Intellectual Property Division opened on February 24, 2022. 

Then on August 11, the Digital Personal Data Protection Act, 2023 was notified and published in the Official Gazette. It applies to digital personal data processing within India and outside the country where it involves goods and services being offered in India. 

August 30 saw the Office of the Controller General of Patents, Designs and Trade Marks inviting stakeholders to submit their feedback and suggestions regarding the revision of manuals and guidelines for different IP rights.  

A breakthrough in India’s legal scene took place when a court proceeding included the recording of evidence from witness testimony and arguments using live transcription for the first time. The patent case Communication Components Antenna Inc v. Rosenberger Hochfrequenztechnik gmbh & Co. Kg. & Ors. was heard before the Delhi High Court which allowed the use of live transcription to record evidence in accordance with Rule 16 of the High Court of Delhi Rules Governing Patent Suits, 2022. 

This was followed by the publication of the draft rules to amend the Geographical Indications of Goods (Registration and Protection) Rules, 2002 in the Gazette on October 17 and in the Ministry of Commerce and Industry’s website on October 27.

The IP community in India and beyond was saddened by the news that Amarjit Singh, a well-known IP practitioner in Delhi and proprietor of Amarjit & Associates died in early 2021. 

Anand and Anand is one of India’s top IP firms, housing more than 200 professionals led by managing partner Pravin Anand, who was the recipient of the International Trademark Association’s (INTA) prestigious 2021 President’s Award.
