Overview
Saya Choudhary Kapur is a graduate from Delhi University with a B. Sc (Hons) degree in Physics. She completed her law from Delhi University and graduated in 2007. She has also done post graduate diploma courses in IPR law and Securities and Banking Laws. She heads a patent litigation team which primarily deals with the patent litigation pertaining to multiple fields including telecommunications, audio coding technology and pharmaceuticals. She has been working with firm for more than 15 years and has handled various landmark cases, which include amongst others Novartis vs Union of India, Merck vs Glenmark, Bayer Corporation Vs. Alembic Pharmaceuticals, Telefonaktiebolaget LM Ericsson Vs. Micromax Infomatics Limited, Dolby International AB v. Vivo, Koninklijke Philips N.V. v. Xiaomi Inc., Telefonaktiebolaget LM Ericsson Vs. Lava International Limited etc.
She has extensive experience in relation to disputes pertaining to the field of Standard Essential Patents. Currently, she is handling all Ericsson’s, Philips’ and Dolby’s infringement suits filed against various Indian and Chinese mobile phone players. She actively advises clients in relation to various issues pertaining to procurement, licensing, and enforcement of Standard Essential Patents. She also has experience of negotiating and executing FRAND licensing deal on behalf of SEP owners. She has also handled various mediation and arbitration proceedings in relation to FRAND licensing issues.
She is actively involved in policy issues as well. She has been recognized as one of the leading patent professionals in India by IAM Magazine from 2017 onwards, consistently. Since 2015, she has been recognised as a leading practitioner in patents in India by Managing IP, IP Stars, WTR 1000, Asialaw, Legal 500 Asia-Pacific, etc. Her excellence in patent matters has garnered widespread recognition.
She has been a regular speaker at various international and national seminars and workshops which include amongst others MIP International Patent Forum, London. She was one of the members who represented India in the International Mock Trial held by Japan Supreme Court
in collaboration with Tokyo High Court and JPO. She is the founding member of Indo German Association for Legal Cooperation. She was also a contributor to the India chapter of the WIPO International Guide for Patent case management for judges.
