    Newest chain of convenience stores in copyright complaint, IPOPHL responds

    It is up to brand owners whether or not to submit a lawsuit against the Dali grocery chain about suspected copyright infringement, according to the Intellectual Property Office of the Philippines (IPOPHL).  

    Previously, Dali was charged by Nutri Asia for violating trademarks, unfair competition and copyright because several of its goods, including Kulina Ketchup and Rajah Pura Vinegar, have packaging that is purportedly identical to Nutri Asia’s UFC and Datu Puti range.  

    After receiving the complaint, IPOPHL issued an injunction against Dali. Group Malayang Konsyumer also sent a letter to IPOPHL about alleged infringing goods being sold in Dali. IPOPHL responded to the group’s letter by texting ABS-CBN News, saying that “the legal rights and enforcement of such rights are up to the IP owners,” adding that IP owners and right holders are also entitled to certain legal remedies. 

    Dali Everyday Grocery has 353 locations, 82 of which are within the trade department’s purview to carry premium items and essentials.  

    Prior to this, a Department of Trade and Industry representative said that the department was looking into any unfair or misleading acts at Dali stores as part of its efforts to safeguard consumers.
