Overview

Tian-ying Zhao joined IntellecPro in 2006, and is currently a partner at the firm. With more than 18 years of experience in intellectual property law, Zhao works both on contentious and non-contentious matters; her practice has a particular focus on trademark portfolio development, trademark oppositions and invalidations, enforcement and litigation of trademark rights and copyrights, and alternative dispute resolution. Additionally, she collaborates with foreign associates to assist clients with patent matters in China.

Zhao primarily advises overseas clients, including many multinational corporations, and is known for her insightful analysis of the situation and thoughtful advices on legal strategies. She is a frequent writer on intellectual property topics, and has been active in International Trademark Association (INTA) committee work since 2014.

Examples of Ms Zhao’s work include:

· Represented the right holder of a popular animation to enforce its trademark rights, copyrights, and merchandising rights through oppositions and invalidations, civil and criminal proceedings, and out-of-court settlement.

· Represented a world-renowned medical service provider to enforce their trademark and tradename rights through administrative actions, and reached a nation-wide settlement with a major infringers.

· Represented an Australian winery in a trademark dispute with a Chinese competitor, defending the winery’s rights over its house mark in trademark invalidation, trademark cancellation and civil litigation.

· Represented a multinational tobacco company in a criminal case against a large criminal gang engaged in manufacturing and exporting counterfeit cigarettes.

· Assisted four international brands to obtain well-known mark recognition in opposition/invalidation court appeals, including a liquor brand, a beer brand, a jewelry brand and a machinery producer.

· Represented a Chinese IT company to settle with a Spanish corporation over a worldwide trademark dispute that involved 75 oppositions in 10 jurisdictions.
