The protection of biological resources, their access and regulation and the application of benefit sharing principles are still in the nascent stage in India, where the recognition of bioresources as intellectual property is slowly but surely being appreciated.
“‘Biological resources’ means plants, animals and micro-organisms or parts thereof, their genetic material and by-products (excluding value added products) with actual or potential use or value but does not include human genetic material.”
