IP Australia extends deadline for requesting extension of time, adds AMEX to payment options

IP Australia is extending the deadline for requests of extensions of time by customers to August 31, 2020. In April, the agency announced that customers impacted by the novel coronavirus Covid-19 may request for extensions of up to three months for free until May 31, 2020. The move aimed to address Covid-19 related problems prohibiting IP rights holders to meet certain deadlines.
A streamlined process is in place to allow customers to file their requests via IP Australia’s eServices system. With some exceptions, the process covers patents, trademarks, designs and deadlines in connection with oppositions and hearings. No fee, declaratory evidence and written explanations are required to file a request.
When required, the other party in an opposition matter is allowed to comment on a rights holder’s request for extension of time within seven business days. Said comment must be made via a written submission.
The deadline could be extended further depending on developments with regard to the pandemic both in Australia and around the world.

IP Australia also announced it is now accepting payments via American Express. The inclusion of AMEX into the agency’s card payment options for customers comes after noting customer feedback about the matter.
