Anyone creating AI materials might still be prosecuted, says MyIPO chairman

Anyone creating material with artificial intelligence apps that looks like it belongs in the nation’s intellectual property register might still be prosecuted.
This was revealed by Intellectual Property Corporation of Malaysia (MyIPO) chairman Mohd Zuhan Mohd Zain at a media meet and greet held in connection with the National Intellectual Property Awards 2024 (AHIN2024) held recently, adding that all IP in the nation is protected by the Trademarks Act 2019, the Patents Act 1983, the Copyright Act 1987, and the Industrial Designs Act 1996.
For instance, he said that even if a song’s lyrics are generated by AI, it would still constitute infringement if the lyrics if those lyrics are already registered under copyright by a publisher.
He also disclosed that MyIPO will discuss matters concerning particular standard operating procedures (SOP) for the application of AI at the World Intellectual Property Organization (WIPO) conference that will take place in Geneva in July. One of the concerns is whether or not those utilizing AI tools could be held liable for copyright-related actions.
Further, Prime Minister Datuk Seri Anwar Ibrahim revealed MyIPO’s involvement in establishing the First National Artificial Intelligence Learning Center through the AI Faculty at Universiti Teknologi Malaysia (UTM).
He said: “We will speak with UTM shortly about the creation of the AI Faculty since, in practice, people utilizing AI must comprehend the directions given by that AI. We will work with them, insha’llah, to make sure that the details and new innovative aspects created under that AI faculty are subsequently synchronized with MyIPO.”
