Myanmar releases new rules governing GIs

Myanmar has taken a significant step toward strengthening intellectual property protection by releasing new rules governing geographical indications (GI).

The Ministry of Commerce issued Notification No. 103/2025, which promulgates the Geographical Indication Rules, creating a full regulatory framework for the registration and administration of GIs under the Trademark Law of 2019. A companion measure, Notification No. 104/2025, was also issued, detailing the official forms required for all GI-related procedures.

The new GI Rules outline the entire lifecycle of GI registration – from filing applications to handling oppositions, cancellations and invalidations – while also mandating the appointment of a local representative for foreign applicants. Under the Trademark Law and the newly issued rules, both domestic and foreign legal entities may seek GI protection, provided they represent a recognized group of stakeholders such as producers of natural resources, agricultural goods, handicrafts or industrial products. Relevant government authorities are also eligible to file applications with Myanmar’s Intellectual Property Department.

The rules also introduce procedures for securing authorization to use the GI logo. Any local or foreign individual engaged in producing or trading a registered GI product within the designated geographic area may apply, provided they belong to the relevant stakeholder organization and comply fully with the product specifications. Approved applicants may display the GI logo on packaging, labels, or stickers.

While the regulatory framework is now in place, several key details remain pending. The government has yet to announce official fees for GI-related processes, and the start date for accepting GI applications has not been confirmed.
