India Increases Fees For Trademarks

The Trade Marks Rules, 2002 have been amended by way of a Notification published in the Gazette of India on August 1, 2014. Such amendment has been subsequently notified by The Controller General of Patents, Designs and Trade Marks vide its Public Notice on August 7, 2014, according to RK Dewan & Co.

 

By the Trade Marks (Amendment) Rules, 2014, the government of India has increased the official fees for filing one trademark application (per mark, per class basis) from Rs.3,500. (US$58) to Rs.4,000 (US$66) and for expedited examination of an application from Rs.12,500 (US$205) to Rs. 20,000 (US$328). The amendment became effect since August 1, 2014.

  

By the Public Notice, the Office of the Controller General of Patents, Designs and Trade Marks has directed all applicants/agents who have filed trademark applications/requests for expedited examinations in respect of applications filed to tender/pay the applicable amounts towards deficiencies in fees (Rs. 500 (US$8) towards trademark application(s) filed and Rs. 2,500 (US$41) towards request(s) for expedited examination in respect of applications filed) between August 1 and August 7, 2014 on or before September 30, 2014 and failing which the Registrar of Trademarks shall not act upon such of the matters and until such additional/deficit fees are paid. The receipt of the deficiencies in fees after September 30, 2014 shall result in the shifting of the filing date to the actual date on payment of balance fees.
