China Has Accepted 235 Sound Trademark Applications

According to the Trademark Office of the State Administration for Industry and Commerce, China began to accept and examine sound trademark since May 1, 2014 and as of now the office has accepted 235 pieces of sound trademarks.  


A sound trademark is a trademark where sound is used to perform the trademark function uniquely identifying the commercial origin of products or services. Sound mark is not new in the world, such as the United States, Australia, New Zealand, Singapore, India, European Union and Hong Kong Special Administrative Region have acknowledged sound mark both in their trademark legislation and judicial law. In order to comply with the international development tendency of trademark registration, the 2013-revised trademark law incorporated sound mark. 


Trademark Office began to accept and examine sound mark as of May 1, 2014 and specially issued Sound Trademark Form and Substantive examination standard (in pilot), examined the sound mark strictly in accordance with legal procedures and standards, and sound mark in conformity with provisions of law has been approved to be registered and protected. And as of now the office has accepted 235 pieces of sound trademarks. 


Consumers are very familiar with some of the sound marks having been applied, for instance, “Yangyangyang” of Hengyuanxiang, “When the sun rises” of Apollo, “Dongdongdong” when your QQ friend is online and the sound of Wechat shaking.
