BharatBenz now a Well-Known Trademark in India

BharatBenz has been granted the Well-Known Trademark status in India by the country’s intellectual property office.  

Headquartered in Chennai, BharatBenz provides modern trucks and buses equipped with advanced safety features. It is a brand under Daimler India Commercial Vehicles, a subsidiary of Daimler Truck AG, Germany. BharatBenz complies with global safety standards including Europe’s ECE R29-03 which regulates vehicles in terms of protection for cabin occupants.  

The Well-Known Trademark status is a special designation under India’s Trade Marks Act, 1999. To determine whether a mark or brand qualifies as a Well-Known Trademark, the Registrar examines different factors. These include public recognition especially within India, the trademark’s duration, use, geographical reach, history of promotion and advertising, extent of the trademark’s registration and successful enforcement and prior recognition by courts or the Registrar.
