Trademark lawyers in Japan are living in interesting times, with momentum gathering against trademarks containing the names of historical figures, an apparent shift taking place from a “first-to-file” rule to a “first to-use” rule, and the astounding ¥25.5 million sale of a trademark which had previously become, by most accounts, a generic term.
